Correction of Your Military Record

The Secretary of each military department, acting through a Board for Correction of Military Records, has authority to change any military record when necessary. They can do this only to correct an error or remove an injustice.

The procedure is not complicated, and you can do it yourself. However, hiring an attorney who is familiar with the process can go a long way to having your application presented in the best possible way to get your record corrected. The application must be filed within three years after discovering the alleged error or injustice. The board may excuse failure to file within this time, however, if it finds it would be in the interest of justice.

In order to get a correction, it is necessary to show that the problem with your record was done in error or was unjust. Applications should include all available evidence, such as signed statements of witnesses or a brief of arguments supporting the correction. That is where an attorney can best assist you. The application is made using DD Form 149, available at VA offices, veterans’ organizations or visit http://www.dtic.mil/whs/di-rectives/infomgt/forms/formsprogram.htm

When do I need an attorney?
